Terms of Service

(1) These General Terms and Conditions (GTC) apply to the use of the KoTodo platform, a web-based task management and project management software with AI support.

(2) Provider is Kottoman GmbH, Heegbarg 31, 22391 Hamburg, Germany (hereinafter "Provider").

(3) These GTC apply to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).

(4) Deviating or supplementary conditions of the user do not become part of the contract unless the provider expressly agrees in writing.

(1) Registration on the platform constitutes an offer by the user to conclude a usage contract.

(2) The contract is concluded when the provider confirms registration by activating the user account.

(3) The user warrants that they are of legal age and have legal capacity, or have the consent of their legal guardian.

(4) For paid services (Pro subscription, credit packages), an additional contract for the respective service is concluded.

(2) The provider strives to provide the platform with 99% availability on an annual average. Maintenance work will be announced in advance when possible.

(3) The provider reserves the right to expand or modify the service offering, provided this is reasonable for the user.

(1) The user receives a simple, non-transferable right to use the platform within the scope of these GTC.

(2) The user retains all rights to content they create (boards, cards, texts). The provider only receives usage rights necessary to provide the service.

(3) The provider may use anonymized usage data for statistical purposes and to improve the service.

(1) The user agrees to:

• Provide accurate information during registration and keep it up to date
• Keep login credentials confidential and protect them from unauthorized access
• Use the platform only within the scope of applicable laws

(2) The following uses are prohibited:

• Distribution of illegal, offensive, or content harmful to minors
• Use for spam or unsolicited advertising
• Attempts to circumvent or impair platform security
• Automated access without prior consent (except via official APIs)

(3) In case of violations, the provider may suspend or terminate the user account.

(1) The Free plan is free of charge. Paid services are subject to prices listed on the website.

(2) Payment is processed through payment service provider Stripe. Their terms of service also apply.

(3) Subscription fees are billed monthly in advance.

(4) In case of payment default, the provider is entitled to block access to paid features.

(1) The usage contract is concluded for an indefinite period.

(2) Free plan: The user can delete their account at any time without notice.

(3) Pro subscription: The subscription can be cancelled at any time at the end of the current billing period.

(4) The right to extraordinary termination for good cause remains unaffected.

(5) After contract termination, user data will be deleted according to our privacy policy.

(1) The provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

(2) In case of slight negligence, the provider is only liable for breach of essential contractual obligations. Liability is limited to foreseeable damages.

(3) The provider is not liable for:

• Data loss caused by inadequate data backup by the user
• Outages outside the provider's sphere of influence
• Content and results of AI assistance (these serve only as support)

(4) Liability limitations also apply to vicarious agents.

(1) The provider reserves the right to change these GTC with effect for the future.

(2) Changes will be communicated by email 30 days before they take effect. If the user does not object within 30 days, the changes are deemed accepted.

(3) The user will be informed of their right to object.
